1. Who we are and agreeing to these terms

Santa's North Pole Tracker (the "Site") is operated by EProducts Empire ("we", "us"). By using the Site you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, please do not use the Site.

2. Who may use the Site

The free pages and games are designed for families to enjoy together. Accounts, purchases and personalization are for parents and legal guardians aged 18 or older only. Children may not create accounts, make purchases or submit information. By creating an account you confirm you are an adult and that any information about a child is provided by you as their parent or guardian.

3. The Santa Tracker and Christmas stories are make-believe

• The Santa Tracker is a fictional, simulated Christmas Eve journey for entertainment. It does not use GPS or real-time location data and does not show where anyone actually is.
• We are not affiliated with, endorsed by or connected to NORAD, Google or any government or tracking service.
• Santa, the elves, the Nice List, Advent surprises and letters are festive storytelling. Nothing on the Site promises gifts, presents, visits or any particular outcome.

4. Accounts

Keep your sign-in details private and tell us if you think your account has been misused. You are responsible for activity on your account. You may close your account at any time by contacting us. We may suspend or close accounts that break these Terms, after notice where reasonable.

5. Digital products, ordering and billing

• All products are digital printables (PDFs) delivered to your account. Nothing is shipped.
• Prices are shown in US dollars. Applicable sales taxes are calculated at checkout. The price charged is the price confirmed on the secure checkout page.
• Payments are processed by our payment processor. Your order is confirmed only after the processor confirms payment; until then nothing is unlocked.
• Personalized items (Santa letters and Nice List certificates) include a set number of personalizations: one per letter or certificate purchase, and exactly one letter and one certificate with the Keepsake Bundle or the Christmas Magic Pass. Unused personalizations do not convert to cash.
• The Christmas Magic Pass is a one-time purchase for the named Christmas season. It is not a subscription and does not renew.
• We try to describe products accurately. If we make an obvious pricing or description error, we may cancel the order and refund you in full.
• Products are only sold once their files are ready. If something you bought cannot be delivered, you will be refunded under the Refund Policy.

6. Your license to use what you buy and see

All artwork, books, text, games and designs on the Site belong to EProducts Empire or its licensors and are protected by copyright and other laws. When you buy a product, we give you a personal, non-exclusive, non-transferable license to download and print it for your own household and non-commercial use, including use in your own home or a small private family gathering. You may not resell, share, upload, redistribute, sublicense, or use our content in products, classrooms for profit, or AI training datasets without our written permission.

7. Acceptable use

You agree not to: scrape, copy or harvest the Site or its files by automated means; try to get around access controls, payment or download protections; interfere with the Site's operation or security; upload harmful code; submit anyone's information without permission; impersonate others; or use the Site for anything unlawful or harmful to children.

8. Crafts and activities

Craft and activity ideas are meant to be done with adult supervision. Use child-safe, age-appropriate materials, keep small parts, scissors, heat and choking hazards away from young children, and check for allergies. You are best placed to judge what is safe for your child.

9. Third-party services and links

We rely on trusted providers for payments, hosting and email. Their services are governed by their own terms. Links to other sites are for convenience; we are not responsible for their content.

10. Availability

We work hard to keep the Site running, especially in December, but we cannot promise it will always be available, uninterrupted or error-free. Features may change. Purchased files remain available in your account for at least the current season and we recommend saving a copy.

11. Warranties

Except as stated in these Terms and to the extent permitted by law, the Site and free content are provided "as is". Paid products will substantially match their description; if they don't, your remedy is a replacement or refund under the Refund Policy. Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.

12. Limits on our liability

To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any claim relating to a purchase is limited to the amount you paid for it (or US$50 for free services). These limits do not apply to liability that cannot be limited by law, including for our fraud, gross negligence, willful misconduct, or for death or personal injury caused by our negligence, and they do not affect your non-waivable statutory rights.

13. Electronic communications

By placing an order you agree that we may send order, delivery, account and policy messages electronically to your account email. These are not marketing. Marketing emails are sent only if you separately opt in, and you can unsubscribe at any time.

14. Questions and disputes

If something goes wrong, please contact us first so we can try to fix it informally. Nothing in these Terms requires arbitration or waives your right to bring a claim in a court with jurisdiction or to contact a consumer protection agency. These Terms are governed by the laws that apply where you live, including any mandatory consumer protections.

15. Changes to these Terms

We may update these Terms. The date at the top shows the latest version, and changes apply going forward, not to orders already placed. We will tell account holders about material changes by email or on the Site.
